Terms of Use

These Terms govern access to and use of StayPay, including hotel booking pages, admin dashboards, payment links, integrations, online check-in, document upload, and related services. By using StayPay, you agree to these Terms.

1. Parties and Roles

“StayPay”, “we”, “our”, or “us” means the operator of the StayPay platform. “Hotel”, “Merchant”, or “you” means the property, owner, manager, staff member, or business using StayPay to manage direct bookings. “Guest” means a person who books, pays, checks in, uploads documents, or otherwise interacts with a hotel through StayPay.

StayPay provides software tools. Hotels remain responsible for their property operations, rates, room availability, guest service, tax obligations, legal compliance, refunds, cancellations, identity verification, and fulfilment of stays.

2. Platform Services

StayPay may provide some or all of the following:

  • direct hotel booking pages and checkout flows;
  • hotel admin dashboard, room, rate, booking, staff, and integration tools;
  • payment mode configuration, payment links, and third-party payment gateway integrations;
  • website, WordPress, button, and booking-link integrations;
  • online guest check-in and document upload features;
  • notifications, reports, support tools, and related product features.

We may add, change, suspend, limit, or remove features at any time. Some features may be beta, experimental, dependent on third parties, or available only on selected plans.

3. Account Registration and Authority

You must provide accurate account, hotel, contact, tax, payment, and operational information. You represent that you have authority to act for the hotel or business you register, invite staff, accept bookings, and configure payments.

You are responsible for all activity under your account, including actions by staff users. Keep OTPs, devices, sessions, and credentials secure. Notify us promptly of unauthorized use.

4. Hotel Content, Rates, Availability, and Policies

Hotels are solely responsible for room descriptions, photos, prices, taxes, fees, cancellation rules, check-in and check-out times, availability, payment rules, guest communications, and all legal disclosures shown to guests.

You must not upload false, misleading, infringing, illegal, unsafe, discriminatory, or deceptive content. We may remove or restrict content or accounts that appear to violate law, these Terms, or platform integrity.

5. Bookings and Guest Relationship

StayPay is not a hotel, travel agent, online travel agency, property manager, insurer, or guarantor of any stay. A booking is a direct relationship between the guest and the hotel. The hotel is responsible for honouring valid bookings, handling overbooking, disputes, guest complaints, cancellations, refunds, no-shows, damage, safety, local registrations, and all applicable hospitality laws.

Guests should verify hotel information, policies, prices, taxes, identity requirements, and payment terms before booking.

6. Payments, Gateways, Refunds, and Taxes

Payment features may rely on third-party payment gateways, banks, card networks, UPI providers, wallets, or other processors. Their own terms, fees, settlement rules, chargeback rules, and compliance requirements apply.

Unless expressly stated otherwise, StayPay does not hold itself out as a bank, payment aggregator, payment wallet, escrow provider, or financial institution. Online payments, settlements, refunds, failed payments, chargebacks, fraud reviews, and KYC may be handled by third-party providers.

Hotels are responsible for taxes, invoices, GST, local levies, pricing accuracy, payment collection, refunds, cancellation charges, and all financial records.

7. Guest Documents and Online Check-in

Online check-in and document upload tools are provided for operational convenience. Hotels are responsible for deciding what documents are legally required, reviewing uploaded documents, protecting guest information, retaining or deleting documents as required, and complying with applicable privacy, registration, police, tourism, and hotel laws.

StayPay does not verify the authenticity of documents, identities, guest eligibility, visas, age, addresses, or legal right to stay unless a separate written service says otherwise.

8. Acceptable Use

You must not use StayPay to:

  • break laws or third-party rights;
  • process unlawful, fraudulent, harmful, or misleading bookings or payments;
  • upload malware, abusive content, forged documents, or illegal material;
  • attempt unauthorized access, scraping, reverse engineering, security testing, or service disruption;
  • misrepresent hotel ownership, licensing, ratings, prices, or availability;
  • use guest data outside lawful, disclosed, and necessary hotel purposes.

9. Plans, Fees, and Suspension

Fees, commissions, usage limits, trial periods, and plan features may vary. We may invoice, collect, deduct, or charge fees as disclosed in your plan, order form, or product interface. Failure to pay may lead to downgrade, suspension, feature limits, or termination.

We may suspend access immediately if we reasonably believe there is fraud, security risk, legal risk, payment risk, data misuse, abuse, or violation of these Terms.

10. Integrations and Third-party Services

StayPay may integrate with websites, WordPress, Google Cloud Storage, Supabase, Stripe, messaging providers, or other services. We are not responsible for third-party outages, terms, pricing, data handling, security incidents, API changes, review decisions, or account suspensions.

11. Intellectual Property

StayPay, its software, design, workflows, APIs, documentation, brand, and platform content are owned by us or our licensors. You receive a limited, revocable, non-exclusive, non-transferable right to use StayPay for your internal hotel booking operations, subject to these Terms.

You retain ownership of hotel content you provide, but grant us a worldwide license to host, process, display, transmit, and use it as needed to operate, secure, support, and improve StayPay.

12. Disclaimers

StayPay is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free operation, booking conversion, revenue uplift, payment success, or legal compliance.

We do not guarantee that bookings will occur, payments will settle, integrations will remain compatible, guest documents will be valid, data will never be lost, or third-party providers will remain available.

13. Limitation of Liability

To the maximum extent permitted by law, StayPay will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or loss-of-profit damages, including loss of bookings, revenue, goodwill, data, business opportunity, settlements, refunds, chargebacks, guest disputes, property damage, personal injury, regulatory action, or third-party failures.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to StayPay will not exceed the fees actually paid by the hotel to StayPay for the three months before the event giving rise to the claim, or INR 10,000, whichever is lower. Some laws may not allow certain exclusions; in that case, liability is limited to the greatest extent allowed.

14. Indemnity

You agree to defend, indemnify, and hold harmless StayPay, its owners, employees, contractors, partners, and service providers from claims, losses, liabilities, penalties, costs, and expenses arising from your hotel operations, content, bookings, payments, taxes, refunds, guest disputes, staff actions, document handling, privacy obligations, legal non-compliance, misuse of the platform, or breach of these Terms.

15. Termination

You may stop using StayPay at any time. We may suspend or terminate access for breach, risk, non-payment, legal reasons, prolonged inactivity, product discontinuation, or platform security. Termination does not affect accrued fees, payment obligations, indemnities, disclaimers, liability limits, or provisions that should reasonably survive.

16. Governing Law and Disputes

Unless a separate written agreement says otherwise, these Terms are governed by the laws of India. Courts located in India will have jurisdiction, subject to any mandatory law that applies. You agree to first try to resolve disputes informally by contacting us.

17. Changes

We may update these Terms. Updated Terms will be posted on this page with a revised date. Continued use of StayPay after changes means you accept the updated Terms.
